The Fair Housing Act

The federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968), together with the Florida Fair Housing Act, makes it unlawful to discriminate in the sale, rental, financing, or advertising of housing based on protected characteristics. As licensed real estate professionals, we are bound by these laws and by the REALTOR® Code of Ethics, which holds us to an even higher standard of equal, honest service.

Protected Classes

Under federal law, it is illegal to discriminate in housing on the basis of:

  • Color
  • National origin
  • Religion
  • Sex
  • Familial status
  • Disability

Under current HUD guidance, discrimination “because of sex” includes sexual orientation and gender identity. Florida law provides parallel protections, and several Florida counties and municipalities extend additional protections — such as age, marital status, or source of income. We honor the broadest set of protections that applies where you live.

What is fair housing?

Fair housing means everyone has the same opportunity to rent, buy, or finance a home without discrimination. The federal Fair Housing Act and Florida law prohibit housing discrimination based on protected characteristics such as race, religion, sex, disability, familial status, and national origin.

Who is protected under fair housing laws?

Federal law protects against discrimination based on race, color, national origin, religion, sex (which HUD interprets to include sexual orientation and gender identity), familial status, and disability. Florida and some local governments add further protections. We serve every client equally, regardless of these characteristics.

What should I do if I think I have experienced housing discrimination?

You can file a complaint with HUD online at hud.gov or by phone at (800) 669-9777, generally within one year of the incident. You are also welcome to contact B Realtors — we will listen and help you understand your options.

Does fair housing apply to buyers as well as renters?

Yes. Fair housing laws cover the sale, rental, and financing of housing, along with advertising and real estate services. As your broker, we provide the same access and the same level of service to every client.
